Recent actions of the Mesquite Country Club HOA

Sirs:

I am a condominium owner at Mesquite Country Club. I am advising you at this time that when I received the mailing regarding the Revised CC&R's last Fall, I was unaware of the fact that there were several important changes buried in that almost half-inch thick document, including one that alters my (or a subsequent owner’s) basic ownership rights to rent my property if I chose or need to do so.

It appears to me that modifications to our governing CC&Rs were orchestrated without prior promotion of open dialogue on all of the proposed changes. Open dialogue and the exchange of views by the
membership produces informed voters casting informed votes. An informed electorate producing a majority vote should be the goal of any representative governing body including the MCC board. When a
“majority” vote is produced without adequate disclosure, that vote becomes tainted and is an insult to our collective concept of representative government.

At a minimum, a truly representative board would have listed all of the proposed changes in the summary data accompanying the request to vote “yes” to avoid an “insurance nightmare”. After all, one of those hidden changes was apparently important enough to cause our HOA to send letters to rental agencies shortly after the election. But, it seems that it was not important enough to bring to the voters attention prior to the needed vote.

Rest assured that had you been open about all the changes included, I would never have voted “yes” to change the CC&Rs in the context that was presented to me.

Therefore, I am formally requesting that you invalidate the results of the prior vote regarding all issues except those directly related to the “insurance crisis” and establish procedures encouraging clear and open
discussion among the membership regarding any future proposed change to our CC&Rs.
