Thanks for your detailed reply.
You are incorrect that the materials you sent are solely for the election of Board of Directors. In fact, your forms are rather downright confusing. For example, the front page titled "Revocable Proxy" has a line of text as follows: "(If you check this box you do not need to complete the back of this proxy)". This text is in conflict with what is printed on the reverse side of the form, at the bottom, and as such confuses what an Owner is supposed to do under section two of the reverse side of the form, or to the actual "Proxy Ballot" section titled: "OTHER ITEMS TO COME BEFORE THE MEETING". Please review this and clarify. I would suggest a corrected Form be sent immediately, with a time extension. Perhaps putting this second section of page 2 (which, by the way, is not "attached" as your instructions state) onto page, 1 would be a simple solution.
On the matter of possible mismanagement, I point out to you that one of the Board Members has been on and off the Board for the past 12 years! The fund is over 90% under-funded...either someone is downright blind, or something else is seriously amiss at MCCHOA. The matters you cite were addressed with past assessments (like the construction defaults that effected the balconies). The project has been around for enough "few years" that there should be NO shortfall in the fund for at least the past 10 years. A $2.16 million dollar suggested Special Assessment is an outrage (figured at $3,600 x 600 units), and calls for nothing less than a complete overhaul of the Board with possible legal ramifications as well.
As is often so true of HOA's, Owners depend on and look to Management to do the correct job, and suffer when they later find out such things as now apparently exist with MCCHOA. You state that there is a plan in place that over the next 10 years will handle this problem, I would ask that you immediately get the details of such plans out to the homeowners so that they can be better informed about the facts and whether or not they want to see any of the present Board Members remain. Furthermore, it would seem highly advisable that MCCHOA open up and more fully cooperate with, as opposed to fighting, the MesquiteOwners organization whom I have copied herein.
